
Up to a point, a wrongful death suit is the
same as a personal injury suit. The main
difference is the money damages that are
available. A 20 year-old man who is severely
injured through someone's negligence can sue for
the medical expenses he incurs, for lost wages,
for pain and suffering that results from the
accident. However, if a 20 year-old man dies in
an accident caused by negligence, the damages
that can be sought by his survivors do not include
the loss of those things that the 20 year old man
is missing out on because he was wrongfully
killed. They cannot recover for the wages that he
would have earned or the life he would have
enjoyed.
However, the man's survivors--wife, children,
parents--can recover for loss of the financial
support they would have received from him and
for their loss in missing out on of his
companionship. Also, the deceased man's estate
can recover compensation for pain and suffering
he went through prior to his death, because of
the negligence. In some cases the damages that
can be recovered are quite substantial.
